CVSN Participant Waiver & Release of Liability

RELEASE OF LIABILITY, WAIVER OF CLAIMS, AND ASSUMPTION OF RISK AGREEMENT

BY AGREEING TO THIS DOCUMENT, YOU ARE WAIVING CERTAIN LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE. PLEASE READ CAREFULLY.

In consideration of being permitted to participate in any way in the soccer training sessions, community pick-up games, clinics, or related athletic events organized or hosted by Coachella Valley Soccer Network (CVSN), I, the participant (or parent/legal guardian if the participant is under 18), acknowledge and agree to the following:

 

1. Assumption of Inherent Risks

I understand that soccer is a physical, high-intensity contact sport that involves inherent risks of injury. These risks include, but are not limited to: muscle strains, sprains, bone fractures, ligament tears, concussions, severe heat-related illnesses (dehydration, heat stroke), cardiac arrest, exposure to communicable diseases (including influenza and COVID-19), paralysis, or even death. I knowingly and freely assume all such risks, both known and unknown, even if arising from the ordinary negligence of the releasees, and assume full physical and financial responsibility for my participation.

 

2. Release of Ordinary Negligence

I, for myself and on behalf of my heirs, assigns, and personal representatives, do hereby RELEASE, WAIVE, AND FOREVER DISCHARGE Coachella Valley Soccer Network (CVSN), its founder Ivan Esquivel, its trainers, field coordinators, volunteers, and sponsoring agencies ("RELEASEES") from any and all liability, claims, or demands for personal injury, property damage, or wrongful death caused by the ordinary negligence of the Releasees, including the maintenance, selection, or condition of the fields, goalposts, cones, or training gear.

 

3. Operational Safety and Medical Clearance

  • I certify that I am in good physical condition and have no medical constraints that prevent me from safely playing soccer.

  • I agree to inspect the field and equipment before playing. If I observe any unusual or significant hazard (e.g., severe field holes, unanchored goals, broken glass), I will immediately remove myself from play and alert the nearest CVSN official.

  • Concussion Protocol (California AB 2007 Compliance): If participating in youth programs, I acknowledge that any player suspected of sustaining a concussion will be immediately removed from play and cannot return until cleared in writing by a licensed healthcare professional.

 

4. Severability & Governing Law

This agreement is intended to be as broad and inclusive as permitted by the laws of the State of California. If any portion of this agreement is held invalid or unenforceable by a court, the remainder of the waiver shall continue in full legal force and effect.

 

FOR PARTICIPANTS OF MINOR AGE (UNDER 18) This is to certify that I, as parent/legal guardian with legal responsibility for this participant, do consent and agree to his/her release as provided above of all the Releasees, and for myself, my heirs, and next of kin, agree to indemnify and hold harmless the Releasees from any and all liabilities incident to my minor child's involvement or participation in these programs.
